Determining Employee Status

When is Someone an Employee?

Please see Employee or Independent Contractor or Sole Proprietor or Subcontractor Guidelines (PDF) for the factors that Chesapeake Employers utilizes to determine whether to include amounts paid to an individual or company in the premium basis for an insured. The list is not meant to be all-inclusive and some factors carry more weight than others. We suggest you contact your insurance agent or your Chesapeake Employers' underwriter or premium auditor in the event you have a question.

Please also refer to Section 9-202 (Covered Employee) of the Workers' Compensation law of Maryland. Click link - Michie's Code of MD, then click the link for Labor and Employment and then click Title 9 Workers' Compensation.
